General terms and conditions
Prices
Unless otherwise agreed in writing in the delivered order confirmation, prices are in Swiss francs (CHF), net ex works, Incoterms 2010, excluding packaging, excluding VAT
Delivery time
The delivery periods stated by Inlabtec are subject to “force majeure” and are non-binding. Any failure to meet the deadline does not entitle the customer to withdraw from the contract or to assert claims for damages.
Shipping
The dispatch of all goods is always, i.e. also in the case of possible carriage paid delivery or other delivery agreements, at the expense and risk of the customer.
Packaging
Packaging is charged at cost price and is not taken back.
Payment
Unless otherwise agreed, invoices from Inlabtec are due within 30 days of the invoice date. The delivered goods remain the property of Inlabtec until payment has been received in full.
Guarantee
For a period of two (2) years from delivery, Inlabtec guarantees that the manufactured and delivered devices are free from material and processing defects that affect the functionality of the device for the intended use. It applies:
1. within the warranty period, Inlabtec shall remedy all defects recognised by Inlabtec that are demonstrably due to material or manufacturing defects. At Inlabtec’s discretion, the warranty will be fulfilled by repairing, replacing defective parts or replacing the device. The execution of guarantee services does not cause an extension or a new start of the guarantee period. However, if the unit needs to be replaced, the warranty period is 2 years from the date of replacement. Replaced parts become the property of Inlabtec. Transport costs, risks and damages are not covered by Inlabtec.
2. The warranty does not cover damage or defects resulting from improper commissioning, connection, improper handling or treatment, repair attempts by unauthorised persons or failure to observe the operating instructions. Furthermore, the warranty is void if repairs are not carried out by Inlabtec or a service partner authorised by Inlabtec, or if original parts have not been used. Further claims, in particular claims for compensation for consequential harm caused by a defect, etc., are excluded to the extent permitted.
3. warranty service is usually provided by the service organisation in the country where the equipment was sold. An obligation to honour the guarantee only exists if the device complies with the applicable technical regulations of the country in which the guarantee claim is made and is operated in accordance with these regulations.
4. warranty services in Switzerland: The warranty services provided by Inlabtec in Switzerland include all costs (material, labour) for the removal of all defects recognised by Inlabtec. For replaced or repaired parts, the warranty period starts again and lasts for 2 years from replacement or completion of the repair.
Applicable law, place of jurisdiction
Swiss law is applicable. Place of jurisdiction is St. Gallen, Switzerland.
Validity
These guarantee conditions are valid from 3 September 2013 and are deemed to be accepted by the buyer when the order is placed. Inlabtec reserves the right to make changes and mandatory law. Deviating individual agreements are reserved and require a written agreement to be valid.
